Terms and Conditions for renting 3A Reef.

 

Reservations for this property are accepted subject to these Terms and Conditions.

 

1.       Agreement.  This agreement is a holiday let solely for the purpose of the guest(s) holiday.  This tenancy is accordingly not an assured tenancy and will be used for the purposes of a holiday, in accordance with Section 12 (2) and paragraph 8 of schedule 4 of the Housing (Scotland) Act 1988.

2.       Contract.  The contract of hire shall be between the Hirer and the property owner.  By signing the booking form you agree that you are over 21 years of age and that you accept full responsibility for all payments due and for the consequences and actions of all persons who will use the property during the holiday. The booking contact shall be deemed as the agent for all persons shown on the form, whether the booking contact intends travelling or not. You are responsible for the safety of any children in your group while at 3A Reef.  Bookings for persons or groups (other than families) under 21 years of age cannot be accepted.

3.       Provisional bookings.  Upon receipt of your enquiry by email or telephone, 3A Reef can be provisionally booked.  This will be held for a period of fourteen days only.  If no booking form and deposit is received within this period, then the provisional booking will be cancelled.

4.       Payment.  Bookings made within 8 weeks of the required holiday date must be paid for in full and in advance of occupation of the property.  For a booking made more than 8 weeks in advance, a deposit of £150 is required.  This deposit will be refunded in full only if the reservation is cancelled more than 8 weeks prior to occupancy or if the owner successfully relets the property. 

5.       Balance.  Upon payment of the deposit and subject to the acceptance of the booking, the applicant becomes liable for the balance of the rental 8 weeks before the period of letting.  If the balance is not received on time, the owner reserves the right to cancel the booking and retain the deposit.  The owner retains the right to alter the booking arrangements if required and change the cottage allocated to that of a similar or higher standard for any reason and without notice in which case the booking deposit will not be returned to the guest without further notice.  Where the owner cannot offer a similar or higher standard cottage the owner reserves the right to cancel the booking arrangements for any reason and without notice in which case the booking deposit will be returned to the guest without further liability.

6.       Cancellation charges.  If the hirer or any member of the party wishes to cancel the whole or any part of the booking once it has been confirmed, the property owner must be informed in writing.  The following cancellation charges will apply:

·          8 or more weeks – loss of deposit only

·          Less than 8 weeks – loss of total holiday cost (unless owner successfully relets the property)

It is recommended that you take out holiday insurance to cover any cancellation fees that may be incurred.

7.       Damage / extra cleaning.  All bookings are accepted on the condition that the property is left in the same state of repair, order and cleanliness both inside and outside as at the start of the holiday.  Major breakages should be reported to the owner immediately and minor damage (such as breaking a cup) should be noted at the termination of the rental period.

8.       Sleeping capacity.  The maximum number of people staying in the property is limited to 4 unless specific arrangements have been agreed with the owner.

9.   Occupation times.  Tenancies commence after 3 pm (unless otherwise agreed,) and terminate at 11am on the leaving date.

10.   Access.  The property owner or her representatives shall be allowed access to 3A Reef at any reasonable time during any holiday occupancy.

11.   Included in the Let.  Bedding (including sheets and pillowcases), towels, tea towels.  A change of bedlinen is provided for two week tenancies. Guests are asked not to take the white bathroom towels outside or to the beach.  Beach towels can be found in the utility area and guests are welcome to use them but are respectfully asked to ensure they are washed, dried and put back after use.  Reasonable electricity usage is included in the rental charge and excess charged at cost if over 400 standard or 400 off peak units.  Lost keys will be charged at replacement cost (including cost of replacing locks).

12.   Smoking.  Smoking is not permitted inside the cottage.  Candles may not be lit.  The open fire may not be used without prior discussion and agreement with the owner.

13.   Pets.  Pets are not allowed except in exceptional circumstances (such as hearing/ guide dogs) and following prior discussion and agreement with the owner. 

14.   Livestock.  The cottage is in a rural area where sheep wander freely.  Tenants are asked to keep the gates closed at all time to prevent them getting into the garden.

15.   Motor cars, bikes and personal belongings are at the tenants risk at all times, and no responsibility can be accepted for loss of, or damage to any vehicle, its contents or other personal belongings.

16.   The owner reserves the right to refuse any booking

17.   The owner reserves the right to terminate this Agreement and ask the tenants to leave immediately if this is deemed necessary by the owner as a result of unacceptable behaviour or any other material breach by the tenants by the terms of this Agreement.  Tenants are asked to give consideration to neighbours and not to cause nuisance or annoyance.

18.   Complaints.  If you have any cause of complaint during your stay at 3A Reef, please immediately notify the owner who will make all reasonable efforts to assist with, and resolve any issues.  The owner will not normally make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to the owner during the holiday rental period.

19.   Data protection and privacy.  Information provided on booking forms will remain confidential and will not be disclosed to a third party or used for any other purpose.
